New JPO Fees

JPO to raise some patent and trademark fees, effective from April 1, 2022

The Japan Patent Office (JPO) recently announced an increase in some patent and trademark fees that will come into effect from April 1, 2022. The new fees will apply to patent annuities (maintenance) and trademark registrations and renewals (see the table below).

The JPO deems these increases necessary because it has been operating at a loss for the last few years. This is in large part due to the JPO’s drive for world-leading digital and infrastructure improvements, as well as the higher examination costs associated with a rising number of international prior art publications. That said, official fees at the JPO are still very competitive compared to other offices such as the USPTO.

In accordance with the rules introduced last year, applicants may request the temporary suspension of the examination of a divisional application until the result of an appeal for the parent application. This has made it more efficient for examiners to examine divisional applications with reference to the appeal results and enabled applicants to refine their divisional claim strategies based on the outcome of the appeal.
